Terms of service

These terms are between you and Sphere Consulting Group LLC, a Wyoming limited liability company at 30 N Gould St Ste R, Sheridan, WY 82801, United States (EIN 30-1326629), which operates Modelworks ("Modelworks"). By using the API or this site you agree to them.

The other documents that form part of this agreement: the refund policy, the privacy policy, and the data processing agreement where personal data is processed on your behalf. The security page describes the system without being a contractual commitment.

The service

Modelworks provides text-to-speech generation over an HTTP API. You send text; the service returns audio. Pricing, the free allowance and the per-character rate are on the pricing page and form part of these terms.

The service is provided as it is. No uptime guarantee is offered, and the status page records what actually happened rather than what was promised.

Keys and accounts

Your API key is confidential. You are responsible for everything done with it, and you should not share it or embed it in client-side code. Tell us at once if it leaks and it will be revoked.

Modelworks may suspend or revoke a key for abuse, for non-payment, or where continued service would break the law or these terms.

Your content

You keep every right you had in the text you send. You grant Modelworks only the permission needed to generate and return the audio for that request.

Text and audio are discarded when the request completes. Request metadata is kept for 30 days, and no request content at all. The security page describes exactly what is logged.

You must be 16 or older to use the service, and you may not use it on behalf of anyone under that age.

You are responsible for the content you generate. Do not use the service to break the law, to infringe someone else's rights, or to impersonate a real person without their permission. Do not use it for content that sexualises minors, for malware, or for fraud.

You may build products on the service and sell them. You may not resell raw access to the API as though it were your own API.

Fees and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle handles the payment, the invoice, and the sales tax, VAT or GST that applies to your purchase, and its own buyer terms apply to the payment itself. Technical support for the API itself is ours: support@modelworks.dev, where one operator reads it and replies.

Charges are per character, as described on the pricing page. There is no minimum and no subscription unless you choose a committed block.

Refunds are governed by the refund policy, which gives you 30 days to ask for your money back on any charge.

Liability

To the extent the law allows, Modelworks is not liable for indirect or consequential loss, including lost profits or lost data. The total liability for any claim is limited to the amount you paid in the three months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law.

Ending the service

You can stop using the service at any time. Modelworks may suspend or end your access for a breach of these terms, for non-payment, or if the service is discontinued - with notice on this page and by email to the address on your account where it can.

Changes

These terms may change. Material changes are published here with a new date, and continued use after the change is acceptance of it.

Law and contact

These terms are governed by the law of Wyoming, United States, and disputes belong to the courts of Wyoming.
